In failing to acknowledge what other courts have actually held, the majority ends up going after a strawman. The majority repeatedly asks whether the enhanced voucher statute creates a “perpetual lease” or “require[s] property owners to continually renew enhanced-voucher tenancies.” E.g., Maj. Op. at 106, 106.13 I cannot discern any reason why the majority would concern itself with whether enhanced voucher holders have an unbridled right to remain; the only people discussing such a limitless right are the two members of the majority. This is not my position. This is not Appellants’ position. This is not HUD’s position. This is not the position of any other court.14
