The Policy Guide lays out that “Owners may not terminate the tenancy of a tenant who exercises this right to remain except for cause under Federal, State or local law.” Section 8 Renewal Policy § 11-3. Moreover, the Guide clarifies that the right to remain continues indefinitely, including after the expiration of a lease term. It provides that “[t]his protection continues after the first lease term” and that “owners must continually renew the lease of an enhanced voucher family.” Id. According to HUD, owners may only choose not to renew a lease if the property is no longer being offered as rental housing, if they have good cause to terminate the tenancy under Federal, State or local law, or if the local housing authority ceases to find the rent being charged reasonable.
