All this is not to say that we are obligated to accept HUD’s interpretation, for we are not. I began with the statute’s text and find that more than sufficient to establish a right to remain. But we are obligated to pay heed to HUD’s interpretation and, given HUD’s consistency, its expertise, and the virtues of uniformity, to give substantial weight to that interpretation. The majority, in its rush to erase the protections of the enhanced voucher statute, fails entirely to engage with this administrative expertise, much less to defer to it.
