. Under section 42 of the code, a developer may qualify for tax credits by making an extended low-income housing commitment. A developer first commits to a compliance period of 15 years, which is followed by an extended use period of at least 15 years or another period of time as agreed upon by the developer and the state agency. 26 U.S.C. §§ 42(h)(6)(D), (i)(I) (2002). 3
