To support its actions under the Ellis Act, AIMCO principally argues that the mitigation conditions of the VTT relate to demolition permits and do not implicate the relocation provisions or its right to go out of the rental business under the Ellis Act. AIMCO also argues that because the VTT was not recorded, its conditions are not binding. We conclude that the mitigation conditions imposed on this project do not conflict with AIMCO’s Ellis Act rights to go out of the rental business because (1) AIMCO agreed to those conditions when it sought approval of its VTT; (2) the mitigation conditions do not impermissibly burden AIMCO’s right to go out of the rental business; and (3) the mitigation conditions, imposed under CEQA, fit within the Ellis Act’s express exception for local land use and environmental regulations. 17 1.
