At the time plaintiffs filed this complaint, the tenant-defendants had not obtained court orders declaring that they *294qualified for protected tenancy status. Arguing that the district court should not proceed without such a determination, the tenant-defendants filed a motion for abstention on April 10, 1982. The district court denied that motion on April 26. On May 25, Troy and East Coast moved to add the four individual investor-plaintiffs— King, Snyder, Weinberg, and Forman — and moved for partial summary judgment on due process, equal protection, and taking grounds. The state-defendants cross-moved for summary judgment on July 6. The tenant-defendants also filed a cross-motion for summary judgment seeking to dismiss the complaint “insofar as it alleges that [section 14] is unconstitutional.”
