The court’s liability finding is based solely on non-compliance with rental ordinances. It
does not decide whether the Property was habitable under 9 V.S.A. § 4457(a) or reach the
argument, apparently first raised in the reply, that the Harrisons also violated the CPA by renting
a property that did not comply with the warranty of habitability. Even if properly raised, there is
a genuine dispute on the conditions of the Property and whether the warranty of habitability was
breached. The Eliasons’ argument that the Harrisons also violated the CPA because they did not
have a lead inspection certificate is not addressed since this is not included in the complaint.
