In Atlas Roofing the government was the prosecuting party. Subsequently the court has made clear that its public rights doctrine does not require participation by the government as a party of record in the administrative litigation. (See Thomas, supra, 473 U.S. 568, 586, 589 [87 L.Ed.2d 409, 423, 425].)
