Defendant responds that we have previously affirmed the constitutionality of rent withholding. (Fisher, supra, 37 Cal. 3d 644.) Fisher, however, did not address the issue posed here. In Fisher we rejected broad due process and preemption challenges to rent withholding provisions similar to those here, but the parties did not raise, nor did we address, the relevance of the judicial powers clause. (Id. at pp. 699-709.)
