308.9. An owner who fails to return the security deposit and interest within the period prescribed in § 308.8, without the tenant's consent, shall be liable to the tenant for:
  (a) The amount of the security deposit;
  (b) Accrued interest;
  (c) A penalty equal to the amount wrongfully withheld; and
  (d) Reasonable attorney fees and costs in a civil action brought to enforce       this section.
