466 charsSection 28.4 does not apply because Schnucks’ consent to a month to month tenancy after the expiration of the lease was not a modification or amendment of the lease, but the creation of a new tenancy after the expiration of the lease. If a tenant at sufferance is turned into a tenant by the landlord’s consent, a new tenancy is created. 1 American Law of Property § 3.35, at 242. A writing is not necessary to create a month to month tenancy. § 441.060.2 RSMo 1986.
