[9] "[W]ho is to say," the majority rhetorically inquires, "that the tenant's counsel would not have been able to find his client with the good news that her defense would go forward (assuming that her presence was essential to that defense)"? Ante at 1143. I suppose anything is possible, but the fact remains that Ms. Douglas's counsel had tried to find her "many times" without success. Id. at 1116 n. 3. In considering whether the trial court properly precluded the tenant's defense, speculative possibilities are not a substitute for lack of evidence.
