Third, for lack of qualified “expert testimony,” the court found the tenant’s evidence insufficient to demonstrate that she “had a mental disability,” and that this disability “caused her not to maintain her apartment in a clean and sanitary condition.” The trial court conceded that testimony from “a psychiatrist or a clinical psychologist” was not necessary; a qualified “social worker or mental health specialist” could suffice.
