A “Rental Housing Agreement” includes an implied agreement for use or occupancy
of a rental unit. (SMRCCA, art. XVIII, § 1801.)

At trial, plaintiff’s counsel represented to the court that as of 2021, plaintiff was aware
defendant was residing in the unit with Milton Reyes as a caregiver, and there is no indication
that plaintiff objected to her occupation.
