The order of dismissal is reversed with respect to appellant’s first cause of action for a violation of the RSO and with respect to her second cause of action for malicious prosecution. In all other respects, the order is affirmed. The case is remanded for further proceedings consistent with the views expressed herein. The trial court shall vacate the order granting respondents’ motion for attorneys’ fees, pursuant to section 425.16, subdivision (c)(1), *116without prejudice to the filing of a new motion for such fees by respondents, thus permitting the trial court to reconsider the issue in light of the views expressed in this opinion. The parties shall bear their own costs on appeal. Klein, P. J., and Aldrich, J., concurred.
