At the time of its rent control decisions in the early twenties a majority of the Supreme Court was of the view that the liberty protected by the due process clause included a freedom of contract which normally precluded either state legislatures or Congress legislating for the District of Columbia from regulating the amounts of prices or wages in businesses “not affected with a public interest.” Legislation invalidated pursuant to this view included attempted uses of the police power to fix *155 minimum wages for women (Adkins v. Children’s Hospital
