This vital interest that is at stake may, of course, be tested in so-called summary proceedings. But the requirements of due process apply and due process entails the right 'to sue and defend in the courts,' a right we have described as 'the alternative of force' in an organized society. Chambers v. Baltimore & Ohio R. Co., 207 U.S. 142 , 148 , 28 S.Ct. 34, 35, 52 L.Ed. 143. In essence the question comes down to notice and an opportunity to defend. Armstrong v.
