Litke’s reliance upon the phrase “[a]ny tenant who vacates the unit under such circumstances” (§ 39.7, subd. (a)(ll)) is misplaced. That phrase refers to the circumstances identified in the preceding sentence: that is, “[t]he landlord seeks in good faith to remove temporarily the unit from housing use in order to be able to carry out capital improvements or rehabilitation work and has obtained all the necessary permits on or before the date upon which notice to vacate is given, and does so without ulterior reasons and with honest intent.” (Ibid.)
