       The plaintiff next argues that the trial court erred by finding that the
plaintiff materially breached the LTA. He maintains that the purpose of the
LTA was to effect the sale of the property to Klemm, which the Trust
accomplished despite the plaintiff’s unilateral resurrection of his tenancy.
Therefore, the plaintiff argues, his reoccupation of the premises did not
constitute a material breach of the LTA that discharged the Trust’s obligation
to pay the lease termination fee. We disagree.
