The trial court found or the record supports the following facts. Gary
Waterhouse and his brother, Kevin Waterhouse, were the trustees of
Waterhouse Realty Trust. The Trust is a former owner of a parcel of
commercial real estate on which it operated Waterhouse Country Store, Inc., a
convenience store. In January 2014, the Trust leased a portion of the store to
the plaintiff for a period of five years to operate a restaurant.
