345 chars461 A.2d 466 (D.C. 1983) (dismissal based upon landlord’s failure to give a notice to quit did not preclude landlord from filing a new suit for possession). We hold that the trial court’s dismissal, based upon a technical defect in the notice to quit, was not a decision on the merits and, accordingly, did not bar South Willow’s second lawsuit.
