       LYNN, J., dissenting. In the name of “protecting” the rights of tenants,
the majority interprets RSA 540:13-c, II (2007) and RSA 540:28 (2007) in a
manner that, contrary to the wishes of both the landlord and the tenant before
us, all but insures that the former statute will be of no assistance to tenants
who have fallen behind in their rent payments. Because neither the text of the
statutes, nor their intended objectives, supports the majority’s construction, I
respectfully dissent.
