The defendants assert that the court improperly determined that Interstate acted recklessly and that JC Corporation was vicariously liable for this recklessness. Specifically, the defendants claim that the court improperly found that JC Corporation also was directly liable for recklessness on the basis of Julie Chen’s actions. Furthermore, the defendants assert that Julie Chen cannot be held individually hable to the plaintiff because she did not owe a duty to the plaintiff in her individual capacity. Finally, the defendants claim that the court improperly determined that Julie Chen was acting as an agent of Hsiao-Wen Chen and Tea House and that both could be held liable for Julie Chen’s alleged recklessness.
