In this action for unlawful detainer, defendant Antun Foster appeals from a judgment
following the granting of a motion for summary judgment in favor of plaintiff Runnymede
Holdings, LLC. On appeal, Foster contends the summary judgment ruling was improper
because: (1) there were material factual issues concerning the affirmative defenses he raised;
and (2) a factual issue remained as to the materiality of any breach. As explained below, we
reverse the judgment because Foster has demonstrated triable issues of material fact exist.
