22.220.120 - Duty to repair and rent—Administrative relief.

In accordance with the procedures specified in Section 22.220.130, the Director may provide full or partial relief from the duty to offer low-income
rental units for rent and/or the duty to make low-income rental units habitable, if
the owner establishes with clear and convincing proof that:

A.

The literal interpretation and strict application of the duty to offer for rent or
the duty to make habitable constitute an unconstitutional taking of the owner's property;

B.

The requested relief would be consistent to the extent possible with the objectives
of this chapter;

C.

The requested relief does not go beyond the minimum necessary to prevent the unconstitutional
taking of property, and does not constitute a grant of special privilege inconsistent
with the limitations upon other similar properties.
