641 charsShortly thereafter, plaintiff filed suit in small claims court under § 535.300, which requires a landlord to return the full amount of a security deposit within thirty days after termination of the tenancy, or furnish the tenant with a written itemized list of damages for which the security deposit, or any portion of it, is withheld, along with any remaining balance of the security deposit. The law allows the landlord to withhold from the security deposit only such amounts as are reasonably necessary, among other things, to restore the dwelling unit to its condition at the commencement of the tenancy, ordinary wear and tear excepted.
