defendant may not recover the costs of suing to enforce a provision of the lease (such as
the plaintiff's rent obligations), when defendant is doing so through a counterclaim in an
action initially brought by plaintiff. (See NYSCEF No. 70 at ¶ 21.) In light
of the court's resolution of defendant's cross-motion, the court does not reach this issue.
