[t]he doctrine of judicial estoppel forbids a party from assuming inconsistent or contradictory positions during the course of a lawsuit. * * * [T]he purpose of judicial estoppel is to protect the integrity of the judicial process from a party who plays "fast and loose with the courts.” * * * For judicial estoppel to apply, however, a party’s subsequent position must be clearly inconsistent with its original position. * * * We have not expressly recognized the doctrine of judicial estoppel and decline to do so here. 12 .
