lease expired, Mr. Dempsey remained in the premises and continued to pay monthly rent (Finding
6), but later there was a “somewhat sudden and premature termination of the lease” (Finding 19).
These findings are not contradictory. After the written lease expired on August 31, 2003, Mr:
Dempsey remained in the premises and continued to pay monthly rent; at that point the implied lease
became a month-to-month rental. Nevertheless, Mr. Riley insisted, over the Dempseys’ objections,
that he had to move back into his house; at some point the Dempseys agreed to be out of the house
