In dismissing the tenant’s complaint, the judge relied on this court’s statement in Castenholz that when a landlord “acknowledges his error and returns the deposit, and the tenant is not forced to resort to litigation to vindicate his rights, the multiple damages and attorney’s fees provisions of [G. L. c. 186, § 15B(7),] have no application.”4 Id. at 763. That sentence does not reach as broadly as the landlord contends.
